What is Reckless Driving?

Florida law defines reckless driving as driving a vehicle with a willful or wanton disregard for the safety of persons or property. Florida law also makes it clear that fleeing and eluding a police officer is per se reckless driving.

Penalties for Reckless Driving

First Conviction - Punishable by up to 90 days in jail and a $500 fine.

Second Conviction - Punishable by up to 6 months in jail and a $1,000 fine.

If there is Property Damage - First Degree Misdemeanor. Punishable by up to 1 year in jail and a $1,000 fine.

If there is Serious Bodily Injury or Death - Third degree felony. Punishable by up to 5 years in prison and a $5,000 fine.
