What is Fleeing and Eluding? Florida law makes it unlawful "for the operator of any vehicle, having knowledge that he or she has been ordered to stop such vehicle by a duly authorized law enforcement officer, willfully to refuse or fail to stop the vehicle in compliance with such order or, having stopped in knowing compliance with such order, willfully to flee in an attempt to elude the officer." Penalties Fleeing and Eluding - Third Degree Felony. Punishable by up to 5 years in prison and a $5,000 fine. Mandatory license suspension ranging from 1 year up to 5 years. Fleeing and Eluding with High Speed or Wanton Disregard - Second Degree Felony. Punishable by up to 15 years in prison and a $10,000 fine. There is a minimum mandatory sentence of 3 years in prison! Mandatory license suspension ranging from 1 year up to 5 years. Fleeing and Eluding After Leaving the Scene of an Accident with Property Damage - Second Degree Felony. Punishable by up to 15 years in prison and a $10,000 fine. There is a minimum mandatory sentence of 3 years in prison! Mandatory license suspension ranging from 1 year up to 5 years. Fleeing and Eluding After Leaving the Scene of an Accident with Serious Bodily Injury or Death - First Degree Felony. Punishable by up to 30 years in prison and a $10,000 fine.
